et al.: Yikes — a terms of services you can understand!
By WDavidStephenson | January 2, 2008
I just signed up for Jiglu, a widget that automatically generates blog tags.
I’m afraid they’re going to get drummed out of the Developers Fraternity, because of their terms of service agreement (first flaw: you can actually read the entire thing without having to scroll down about 20 screens. second flaw: it’s written in plain English. third flaw: it isn’t printed in agate type, but is actually readable). Here’s the entire text:
“We are very conscious that most people are asked to click on terms of service without ever being given a clear idea of what it is that they are allowed to do, or not, unless they have practiced law for some significant period of time.
“This strikes as a little unfair, and so what we intend to do here is to set out what you can and can’t do with our service, and what we are allowed to do.
“Don’t get this wrong, just because this is written in friendly language doesn’t mean that we are going to allow you to do anything at all with the service. In fact, quite the opposite. We are rather proud of it, and don’t want anyone trashing it, thank you very much.”
Yikes: this has got to be squashed ASAP, or we’ll have tons of attorneys standing on corners selling pencils or apples (their sandwich boards would read “Buddy, can ya spare a country-club membership?).
My lawyer will call your lawyer in the morning.
PS: my younger brother, great appellate attorney for the indigent, is hereby exempt from this ad hominem attack!
PSS: after learning more about Jiglu, I decided to not install it, because it automates the tag creation process, with no provision for manual tagging, which ain’t for me, but probably would work for personal blogs with simple subject matter….
